Food Facility Registration Deadline: Enforcement Discretion Does Not Mean Procrastination!

By now food manufacturers should be more than aware of the new Biennial Food Facility Registration requirement set forth under the Food Safety Modernization Act (If not, read this NOW).  Though registration is a relatively painless process, it can be time-consuming and frustrating, especially for those who registered several years ago and now must find or obtain their login credentials.

FDA has taken note of the food industry’s scramble to obtain their login credentials and complete their registrations.  FDA recently released a statement to the effect that officials may “exercise enforcement discretion with respect to registration renewals submitted to FDA after December 31, 2012 for a period of 31 days, until January 31, 2013.”  This is good news for those registrants who are making a good faith effort to register but are encountering some difficulties.  This update means that, as long as FDA has evidence that a firm intends to renew, it will likely be lenient in penalizing such firms.  However, this “enforcement discretion” will generally not extend to firms that are delinquent in registration and are counting on this as an extension of the registration date.  In other words, don’t be lazy but if you’re having trouble you just got a few extra weeks.
