The mission of Food and Drug Administration (FDA) is to protect the public health by enforcing the Federal Food, Drug, and Cosmetic (FD&C) Act and other laws which are designed to protect consumers' health and safety. These laws apply equally to domestic and imported products.

Foods, drugs, biologics, cosmetics, medical devices, and most radiation-emitting electronic products are subject to examination by FDA when they are being imported or offered for import into the United States. While most meat, poultry, seafood, and raw agricultural products are regulated by the U.S. Department of Agriculture (USDA).

All imported products are required to meet the same standards as domestic goods. Imported foods must be pure, wholesome, safe to eat, and produced under sanitary conditions; drugs and devices must be safe and effective; cosmetics must be safe and made from approved ingredients; radiation-emitting devices must meet established standards; and all products must contain informative and truthful labeling in English.  And all products must conform to complex laws and regulations relating to their labeling.

When importing products into the United States, it’s important to know the laws, regulations, and procedures your company must follow. There are a few tricks when importing food entries that can help speed up the process:

  • Determine before shipment that the imported product is legal.
  • Have private laboratories examine samples of foods to be imported and certify the analysis of the processor. While not conclusive, these analyses might serve as an indication of the processor's ability to produce acceptable, legal products.
  • Become acquainted with FDA's legal requirements, before contracting for a shipment.
  • Request assistance from the FDA District Office responsible for your port of entry.
